Mediation in criminal and civil matters is based on the Act on Conciliation in Criminal and Certain Civil Cases (1015/2005).
Prerequisites
The parties involved in a criminal or civil case, a guardian of a minor, the police or prosecutor and other authorities can submit a mediation request to the mediation office. In domestic violence cases, only the police or prosecutor can initiate mediation. The mediation office will assess whether the case is suitable for mediation with the parties involved.
In a mediation meeting, the parties meet face-to-face to discuss the events and look for a mutually satisfying solution. The discussion is guided by impartial mediators.
Usually mediation cases involve violent offences, property offences or various civil cases. As a result of mediation, the authorities may suspend the court proceedings or the mediation may be taken into account when considering a potential sentence.
Mediation can be attended by a guardian, a custodian or some other legal representative and an interpreter. It is also possible to have an assistant or a support person present during mediation.
Mediation can be requested:
- by a party involved in a criminal or civil case,
- by a guardian or a custodian
- by the police or prosecutor
- by any other person of authority.
A mediation request is submitted to the mediation office. In domestic violence cases, only the police or prosecutor can initiate mediation. The professionals at the mediation office will assess whether the case is suitable for mediation and give advice on all details.
